These Subscription Terms and Conditions govern the purchase and use of the PhotoHeart subscription service, a comprehensive management platform for professional photographers.

2. Service Description

PhotoHeart is a SaaS (Software as a Service) platform that provides professional photographers with tools for:

  • Private gallery management and image delivery to clients
  • CRM (client relationship management)
  • Invoicing and quotes
  • Photo session management
  • Workflow automation
  • Integrations with external services (Gmail, Google Calendar, etc.)

3. Plans and Pricing

3.1. Professional Plan

Monthly price: €35.90/month Annual price: €359/year Prices indicated do not include VAT. Applicable VAT is calculated automatically at checkout based on the customer's country of residence (21% in Spain, and the corresponding rates for other EU member states). The final amount, with VAT itemised, is shown before subscription confirmation and on the issued invoice.

3.2. Free Trial Period

We offer a free trial period of 14 days for new users:

  • Full access to all features
  • A valid payment method (credit or debit card) is required to start the trial
  • No charge is made during the 14-day trial period
  • You can cancel at any time before the trial ends and no charge will be made
  • If you do not cancel before the 14 days end, the subscription will activate automatically and the first charge will be made to the payment method provided

4. Subscription and Payment

4.1. Subscription Process

When subscribing:

  • You must create an account on PhotoHeart
  • Select the desired plan (monthly or annual)
  • Provide a valid payment method
  • Accept these Terms and our Privacy Policy

4.2. Payment Processing

Payments are processed securely by Stripe (PCI DSS Level 1). PhotoHeart does not store credit card numbers or complete banking details. By providing your payment details, you agree to Stripe's Terms of Service.

4.3. Accepted Payment Methods

  • Credit cards (Visa, Mastercard, American Express)
  • Debit cards

You can update your payment method at any time from Settings → Subscription.

4.4. Failed Payments

If a payment fails:

  • Your account will move to a restricted state until you update your payment method
  • Stripe will automatically retry the charge (up to 8 times over 2 weeks)
  • You will receive email notifications
  • You can update your payment method at any time to restore access

4.5. Invoicing

Invoices are automatically issued at the beginning of each billing period and are available in your control panel.

5. Automatic Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. We will send you a reminder by email before each annual renewal.

6. Billing Frequency Changes

PhotoHeart offers a single plan (Professional) with two billing options: monthly or annual.

If you wish to switch from monthly to annual (or vice versa), the change will take effect at the end of your current billing period. Your subscription will continue with the current frequency until it expires, at which point you can subscribe with the new option.

7. Cancellation

7.1. How to Cancel

You can cancel your subscription at any time from your control panel or by contacting support@photoheart.app.

7.2. Effects of Cancellation

  • You will retain access until the end of the current billing period
  • No further automatic charges will be made
  • Your account will move to a "restricted" state after the already-paid period
  • You can export your data and reactivate your subscription at any time

7.3. Data Deletion

After effective cancellation:

Important: This action is irreversible. You can export your data before deletion.

7.4. Data Export

You can export all your data at any time (GDPR data portability right) from Settings → Storage:

  • Contacts (CRM)
  • Sessions and selections
  • Quotes and invoices (Excel + PDF)
  • Signed contracts (Excel + PDF)
  • Appointments
  • Catalog (packages and products)

7.5. No Minimum Commitment

There is no minimum commitment period. You can cancel your subscription at any time without penalty.

8. Refund Policy

8.1. Satisfaction Guarantee

We offer a 3 calendar day satisfaction guarantee exclusively for the first paid subscription, after the free trial period. If you are not satisfied within the first 3 days after the first charge, you can request a full refund by contacting support@photoheart.app.

8.2. Renewals

Automatic renewal charges (second month/year onwards) are non-refundable. If you do not want to be charged for the renewal, you must cancel before the renewal date.

8.3. Billing Frequency Changes

When switching between monthly and annual billing, the change takes effect at the end of your current billing period. No refunds are issued for the remaining period.

9. Customer Retention

If you decide to cancel your subscription and have been a customer for at least 2 months, we may offer you a 25% discount coupon for 3 months as an incentive to continue using the service. This offer is optional and does not imply any obligation.

10. Price Modification

We reserve the right to modify the prices of our plans. In case of a price increase:

  • We will notify you at least 30 days in advance
  • The new price will apply at your next renewal
  • You may cancel your subscription if you do not agree with the new price

11. Acceptable Use

When using PhotoHeart you agree to:

  • Not use the service for illegal purposes
  • Not upload content that infringes copyright or intellectual property rights
  • Not attempt to access other users' accounts
  • Not reverse engineer the software
  • Not use the service to send spam or unsolicited communications

12. Intellectual Property

PhotoHeart and its content (design, code, brand, logos) are the property of JorgeX Technologies LLC. Users retain all rights over the images and content they upload to the platform.

13. Limitation of Liability

PhotoHeart is provided "as is". To the extent permitted by law:

  • We do not guarantee that the service will be error-free or uninterrupted
  • We are not liable for indirect or consequential losses
  • Our maximum liability is limited to the amount paid in the last 12 months

14. Data Protection and Cookies

The processing of personal data is governed by our Privacy Policy.

The use of cookies and similar technologies is governed by our Cookie Policy.

15. Modification of Terms

We may modify these Terms occasionally. We will notify you of any significant changes by email. Continued use of the service after the modification implies acceptance of the new Terms.

16. Applicable Law and Jurisdiction

For users in Spain and the European Union, these Terms are governed by Spanish law, without prejudice to the mandatory consumer protection rules that may be applicable. For dispute resolution, the courts and tribunals of the consumer's place of residence shall have jurisdiction.
